ITALY – IP LEGISLATION Italian government publishes 3-year action plan for intellectual property An ambitious and challenging action plan to strengthen the protection and enforcement of intellectual property in Italy: the Italian Ministry for Economic Development has published its strategy guidelines for intellectual property for the years 2021-2023, the first measure implementing the Italian National Recovery and Resilience Plan. ITALY – PATENT BOX Italy changes patent box rules Italy’s patent box, formerly concerning profits deriving from the exploitation of certain intangible assets, has been turned into a super-deduction for costs incurred for research and development of the assets; implementation rules are yet to be published, amid rumours of corrective measures being considered pursuant to criticism against the changes. 	ITALY – TRADEMARK LEGISLATION New forms of representation of the mark in Italian trademark applications Changes in force since September 2021 include new rules on how to represent trademarks other than graphically in Italian trademark applications. (more)
EUROPE – UNIFIED PATENT COURT Unified Patent Court makes progress, but unresolved Brexit issues still loom The Unified Patent Court is to kick off in a matter of months according to official announcements, although some of the issues raised by the United Kingdom’s withdrawal are as yet unresolved.
