European Commission proposes SPC waiver

The European Commission has proposed the introduction of an SPC waiver aiming to make European Union-based generic and biosimilar manufacturers more competitive on the global market; there is concern that the changing patent protection rules for medicinal products could hurt Europe’s ability to attract investors in medical and pharma research. Italy implements EU Directive on trade secrets

Legislative Decree No. 63/2018 came into force on 22 June 2018, implementing into Italian law the European Union Directive No. 943/2016 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure. (more)

Italian Supreme Court rules on registration of trademarks in bad faith in Radio Vicenza

The Italian Supreme Court has confirmed that Article 19 (2) of the Industrial Property Code prohibiting registration of trademarks in bad faith does not apply to the registration of abandoned trademarks that have ceased to produce effects. (more)
